Who Pays for AC, Chiller and Maintenance in Dubai
In Dubai the landlord is responsible for maintenance under Article 16 of Law 26 of 2007 unless the contract clearly agrees otherwise. Major repairs, such as a failed AC chiller or compressor, structural issues, and main plumbing or wiring, are the landlord’s cost. What the law says
Article 16 of Law 26 of 2007 places maintenance on the landlord during the tenancy unless both parties agree otherwise in the contract. The important part is that the agreement has to be reasonable. A landlord cannot use a single clause to push a major structural or chiller repair onto the tenant, and the Rental Dispute Center has struck down clauses that try to.

The chiller question
Chiller breakdowns are a frequent dispute because they are expensive. Unless the contract fairly and specifically agrees otherwise, a chiller or compressor failure is the landlord’s responsibility as a major system. A clause that caps the landlord’s yearly maintenance at a low figure, or forces the tenant to replace a failed chiller, is the kind the RDC has refused to enforce.
