The landlord 12-month rule
If a landlord wants a tenant to vacate at the end of the term, Article 25(2) allows it only for specific reasons and requires 12 months written notice served through a Notary Public or by registered mail. The four grounds are the sale of the property, the landlord using it personally or for a first-degree relative, demolition or reconstruction, and major renovation that needs the unit empty. The notice must state the reason.
Serving the notice correctly
The method matters as much as the timing. A landlord notice under Article 25(2) is valid when it goes through a Notary Public or registered mail, so the date and delivery can be proven later. Keep the stamped copy or the registered mail receipt with your records.
Tenant non-renewal
A tenant who does not wish to renew should give clear written notice, ideally at least 90 days before the expiry date, and confirm the vacating date, the return of keys and access cards, and the closure of utilities. This helps the deposit return go smoothly.
